Breaking News: SD Supreme Court says "Summit Carbon Solutions has not demonstrated that it is a common carrier “holding itself out to the general public as transporting a commodity for hire.”
In a big and positive twist for landowners and others opposing the Summit Carbon Solution CO2 pipeline, the South Dakota Supreme Court has ruled that the company may not meet the requirements for “common carrier status” which would preclude it from using eminent domain powers to seize property to finish the project.
